Delta Flight Delay Compensation — Claim up to £520
Delta Air Lines is a US carrier, outside the UK and EU, so UK261 protects you only on Delta flights departing from a UK airport — not on flights arriving into the UK from the United States. The leg you were delayed on decides your claim, with one exception worth knowing: many “Delta” transatlantic flights are actually operated by its joint-venture partner Virgin Atlantic, a UK airline, and those flights are covered in both directions.

How Much You Can Claim
Compensation by Distance
Amounts are fixed by flight distance, per passenger, regardless of ticket price:
- £220 — short-haul, up to 1,500 km
- £350 — medium-haul, 1,500 to 3,500 km
- £520 — long-haul, over 3,500 km
- Paid in cash — a budget fare and a premium fare receive the same amount
The Three-Hour Rule
Eligibility turns on your arrival, not your departure:
- You must arrive at your final destination 3 or more hours late
- Arrival is measured when the aircraft doors open
- A late take-off that makes up time in the air may not qualify
- The delay must be within the airline’s control — not extraordinary circumstances
When Delta Flights Are Covered
Your Coverage
Because Delta is based outside the UK and EU, coverage is one-directional:
- Departing a UK airport on Delta (e.g. London Heathrow to New York JFK) — covered by UK261
- Arriving into the UK from the US on a Delta-operated flight — NOT covered (non-UK/EU carrier inbound)
- On a Delta flight number operated by Virgin Atlantic — covered in BOTH directions, because coverage follows the airline that operated the flight, and Virgin Atlantic is a UK carrier
What This Means in Practice
Delta connects London Heathrow and Edinburgh with its US hubs — New York JFK, Boston and Atlanta among them. London to New York is around 5,570 km, comfortably in the £520 long-haul band, and every transatlantic Delta route from the UK sits in that band.
The Virgin Atlantic point matters more than it sounds: Delta and Virgin Atlantic run their transatlantic routes as a joint venture and sell seats on each other’s aircraft, so the operating carrier on “your Delta flight” may well have been Virgin. - Booking reference and ticket
- Boarding passes for each leg
- The actual arrival time at your final destination
- Any delay notification or reason the airline gave

The process is the same for most airlines:

- The airline must provide food, drink and communication during long delays

My flight was only delayed at departure but arrived on time. Can I claim?
No. Compensation depends entirely on your arrival time at the final destination, measured when the aircraft doors open. A late departure the crew make up in the air, leaving you under three hours late on arrival, doesn’t qualify — however frustrating the wait at the gate.
Does it matter what I paid for my ticket?
Not at all. The compensation amounts are fixed by distance and identical for every passenger on the flight. Someone on a discounted fare receives exactly the same as someone in a premium cabin — the figure reflects the disruption, not the price of the ticket.
My Delta flight INTO the UK was delayed. Am I covered?
If Delta operated the aircraft, generally not under UK261 — a US carrier’s flights are only covered departing from a UK airport. But check who actually operated the flight: Delta sells many transatlantic seats on Virgin Atlantic aircraft under its joint venture, and Virgin Atlantic is a UK carrier, so a Virgin-operated flight into the UK is covered even on a Delta flight number. The other exception is a connecting journey that began with a UK departure, where your delay is measured at your final destination.
